Welcome to My Daily Soothe. These Terms of Service govern your access to and use of our website mydailysoothe.com and any purchases you make. By accessing our site or placing an order, you agree to be bound by these terms.
1. General Conditions
· We reserve the right to refuse service to anyone, at any time, for any reason. You agree not to reproduce, duplicate, or exploit any portion of the Service without our express written permission.
2. Products & Customization
· Accuracy: We strive to display product colors and images as accurately as possible but cannot guarantee your screen’s display accuracy.
· Custom & Made-to-Order Items: By purchasing a customized, personalized, or made-to-order product (e.g., zodiac silk underwear, monogrammed sleep masks), you acknowledge that these items are produced uniquely for you. All sales for such items are final. You grant us the right to proceed with production upon order confirmation, and you cannot cancel, modify, or request a refund after production has begun, except in cases of proven defect.
· Silk Care: Due to the delicate nature of silk, you acknowledge that proper care is required. We are not responsible for damage resulting from improper washing, handling, or use.
3. Order & Account Information
· Accuracy: You are responsible for providing accurate shipping, contact, and (for custom items) personalization details. We are not liable for delays or failures due to incorrect information.
· Order Acceptance: Each order is an offer to purchase. We reserve the right to cancel any order for reasons including, but not limited to, product availability, errors in pricing, or suspicion of fraud.
4. Pricing, Shipping & Billing
· Pricing: Prices are in USD and subject to change. You are charged the price listed at the time of order confirmation.
· Shipping: We offer free standard shipping on orders over $99 USD. Shipping fees for orders below this threshold are non-refundable.
· Partial Refunds: If a partial refund is issued on an order that originally qualified for free shipping, and the remaining order value falls below $99, the original shipping fee may be deducted from the refund amount.
· International Duties: You are responsible for any customs duties, taxes, or fees imposed by your country.
5. Returns, Refunds & Exchanges
Our Return and Refund Policy (link to the full policy page) is incorporated into these Terms.
· Custom/Personalized Items: All sales are final. No returns, exchanges, or refunds are accepted, except for damaged or defective items.
· Standard Silk Products: Due to the intimate and delicate nature of silk, non-customized silk products are also final sale unless defective.
· Other Products: Please refer to our full Return Policy for terms applicable to non-silk items.
· Process: Returns require a Return Merchandise Authorization (RMA). Items must be unused, in original packaging. Return shipping is the customer’s responsibility.
6. Intellectual Property
All content on this site (logos, text, designs, product imagery) is our exclusive property. You may not use it for any commercial purpose without our prior written consent.
7. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of our service or products.
8. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Los Angeles County, California.
9. Changes to Terms
We may update these Terms at any time. Changes take effect upon posting to the site. Your continued use of the site constitutes acceptance.
